Our client is a prominent business in Birmingham, specialising in residential property management services. They are seeking a highly experienced and knowledgeable Head of Litigation to lead their legal team and provide expert guidance on all matters related to landlord and tenant law. This role is essential in ensuring compliance, protecting the company's interests, and upholding the rights of their clients.
The Role
The Head of Litigation will be responsible for overseeing all legal aspects of the property management business, with a primary focus on landlord and tenant law. This role requires a seasoned solicitor with at least 10 years of post-qualification experience (PQE), extensive knowledge of relevant legislation, and a deep understanding of the property management industry.
The successful candidate will have the following key responsibilities:
1. Expertise in Landlord and Tenant Legislation:
- In-depth knowledge of the Landlord & Tenant Act 1985/1987 and the Commonhold & Leasehold Reform Act 2002.
- Keep abreast of any legislative changes and ensure company compliance.
2. Litigation Management:
- Manage and handle a diverse portfolio of cases, including debt recovery (small claims/fast track/multi-track), breach of lease (county court action/FTT tribunal action), forfeiture & possession proceedings, lease extensions, and lease variations.
- Prepare and represent the company in First-tier Tribunal (FTT) applications.
- Provide expertise in key case law surrounding leasehold legislation.
3. Lease Analysis and Enforcement:
- Analyse complex leases and provide strategic advice to the company.
- Lead enforcement efforts, including judgment enforcement and appointment of manager applications.
4. Property Management Industry Knowledge:
- Possess a full understanding of the property management industry, including familiarity with institutional landlords and agents.
- Provide guidance on the Right to Manage (RTM) process and structure.
5. Advisory Work:
- Offer advice on major works consultation, s20b notices, lease variations, lease structure, and notices of repairs.
- Provide support to the process team and offer training to staff when necessary.
6. Collaboration:
- Collaborate closely with the litigation team, providing advice and support as needed.
- Liaise with other departments to ensure legal compliance and mitigate risks.
7. Knowledge of Companies Act 2006:
- Possess some knowledge of the Companies Act 2006, especially as it relates to property management companies.
The Person
- A qualified solicitor with a minimum of 10 years PQE.
- Extensive experience in landlord and tenant law, including litigation and advisory work.
- Profound understanding of the property management industry, with knowledge of institutional landlords and agents.
- Exceptional analytical and problem-solving skills.
- Strong leadership and team management abilities.
- Excellent communication and negotiation skills.
- A commitment to staying updated on changes in legislation and case law.
